[NOTE: This article was from a Japanese Tabloid Magazine,
"JOSEI-JISHIN", and as if it would said JYJ wanted to settle with SM,
but please note the party who applied the arbitration just a few day
before the judgement of the lawsuit was SM side actually. So, please
read this just for your information.]
《The lawsuits
between SM Entertainment and JYJ who are at odd with issues regarding
TVXQ's exclusive contract. The judgement was going to be out at 10
o'clock am, on July 19th, at the Seoul Central District Court, but it
was revealed that the both is to attend the arbitration for the
settlement again.》
On 19th, Korean newspaper
"CHOSEN-NIPPO" reported that Yunho (26) and Changmin (24) of TVXQ, and 3
members of JYJ, Jaejoong (26), Junsu (25), and Yuchun (26) will sit
down at the negotiating table for the settlement.
It was
in July, 2009, when 3 members of JYJ had sued the lawsuits against their
ex-agency SM Company. The ongoing lawsuits have kept being engaged in
mud-slinging for full 3 years, but I wonder they would be given the
answer enough to meet fans' expects for the settlement at the
arbitration which will be held on August 10th.
Park
InDong, who has a license of lawyer in Korea and has been working in
Japan, regards as follows;"In a case of that there is almost no way to
go to the resolution through the lawsuit, the both parties suggest the
plan of the settlement and have the negotiation. At that time, if they
both agree to it, the settlement will be made . This time, we can say
that a word "for the settlement" means the both suggests to concession.
Also, I think there would be a way of monetary resolution."
Anyway,
what is a reason for the movement for the settlement at this timing
--."The both party, it is a real intention that they want to quit the
lawsuits soon. TVXQ and JYJ also don't want to let themself image-down
by dragging the lawsuits longer. In particular, the party who wants to
end earlier would be JYJ side, because they are virtually restricted to
do their activities both in Korea and in Japan. "(Person Concerned in
Korean Music Industry)
The arbitrations they had 6 times
so far fell through. I wonder it will be brought to the settlement
easily this time."JYJ seems to make a decision like 'We want to settle
this time' even if they would accept the harsh conditions. If the
settlements will be made in some way, I think there is a possibility to
stand on the same stage as 5 on the music programs, etc. Korean
broadcasting companies side hopes the both group to work together ...

An article on “Yahoo! Japan” touched on the August 10th arbitration meeting but the content is unreliable as it was based on a tabloid. The information included is also inaccurate and misleading.
The truth:
It was SM that requested arbitration, not JYJ.
JYJ has never requested arbitration nor have they ever pushed for a settlement as the article suggests.
The entire legal matter is strictly between JYJ and SM Entertainment. The article says that JYJ’s Jaejoong, Yoochun, & Junsu, together with TVXQ’s Yunho & Changmin will sit to negotiate a settlement. That statement itself hints that the dispute is between the five. However, this has never been a case of JYJ vs TVXQ in the court. The only legal parties that would be involved in forming an agreement or deciding to settle the dispute would be JYJ and SM Entertainment.
The arbitration meeting could go several ways. It does not necessarily mean that they (JYJ and SM) will meet to come to an agreement or that they will settle their dispute once and for all. (This is why I personally don’t want to get my hopes up. I prefer to wait and see what happens.)
